My Precious Poms extends the following guarantee to the buyer(s) below:

~~We guarantee only the puppy described below
~~We do not guarantee the coloring, temperament, size, coat, personality, conformation or breeding capabilities of this puppy
~~ This health guarantee is in affect for 1 (one) year from the date of birth, for life threatening congenital birth defects ONLY, such as heart, lung, kidney, and liver defects if documented by a licensed veterinarian within 1 (one) year from the date of puppy’s birth.
~~All puppies have been vaccinated and dewormed before leaving our home.
~~The buyer agrees to never sell or give up this puppy to any pet shop, puppy mill, or similar institution. If owner is unable to keep the puppy they must contact the breeder. Any unwanted pet may be returned at no compensation.
~~ The Buyer agrees to send updated pictures of said puppy as they grow up, this is essential for us to provide accurate dispositions of future litters when pairing.
~~The buyer agrees to NOT allow said puppy outside until all shots have been completed!

~~The Buyer agrees to keep puppy up to date on all vaccinations.
~~This puppy IS / IS NOT sold on a strict spay/neuter contract. If it is, this puppy is a pet only and may not be used for breeding under any circumstance. The Buyer agrees not to breed this dog. This puppy will be registered with limited registration and spaying/neutering is required by 6 months of age. Limited AKC or CKC papers will be held by Breeder until proof of spay/neuter is received. If proof of spay/neuter is not provided by 6 months of age legal action will be taken and buyer understands they will loose possession of said dog. Limited registration in no way prevents this puppy from participating in any AKC event except for the conformation ring.
~~If sold to a breeding home any puppies purchased from us must be registered with our kennel name on their papers in front of their name. “My Precious Poms (name of your dog)”. This lets other breeders and buyers know where the dogs lines come from. Failure to do so will result in us contacting AKC and having them revoke breeding rights on said dog and breeder shall be entitled to the sum of five thousand dollars ($5,000) for damages incurred to “My Precious Poms” reputation for each litter produced under wrong name.
~~ Permanent ownership of this dog is contingent upon your compliance with this Agreement. Proof of the spay/neuter must be received by the purchaser and/or new owner within fourteen (14) days after the surgery. In the event that the dog’s health does not allow this agreement to be honored, MYPRECIOUSPOMS must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this dog the (purchaser) will contact the veterinarian and establish the earliest date that the procedure can be performed. (THE PURCHASER) will notify the BREEDER of this amendment in writing (mypreciouspoms@gmail.com), at which time all other conditions of this agreement will apply and be enforced.
~~ It is the responsibility of the PURCHASER, not the veterinarian, to ensure that MYPRECIOUSPOMS has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the contract, and PURCHASER will pay to transport or transport this dog back to MYPRECIOUSPOMS and will not be entitled to a refund.
~~ The buyer shall take full responsibility for this puppy and its actions. We assume no responsibility for this puppy once it leaves our home; be it vet bills, landlords disapproval, allergy to animals, disagreement of family members, personal and property damage.
~~If not spayed/neutered by written date below then the additional penalty due is $5,000.00 by legal action, or the return of said dog. Please send vet’s proof of neuter or invoice bill with the vet’s state license number and his/her signature for verification. Proof must include the puppy’s gender, coat color, and birthday.

~~By my signature below, I agree to have this dog spayed/neutered by no later than 6 months old, by _____________, and I understand that this spay/neuter agreement is an agreement that this dog will not produce a litter of puppies either as purposely bred or by accidental breeding. Accidental breeding is considered neglect and the dog/bitch will be returned to us and all puppies born from any breeding, accidental or otherwise, will become the property of MyPreciousPoms. In addition I understand a penalty of $2,000 per puppy born is due to MyPreciousPoms. I also agree that should puppy not be altered that I will return said puppy back to MyPreciousPoms with no refund.
~~We do not cover your expense. After this puppy leaves our home, the buyer us responsible for ALL VET BILLS; including but not limited to, physicals, vaccinations, medications, blood tests, x-rays, ultrasounds, surgeries, autopsies, boarding, grooming, etc… The buyer must pay these bills no matter what the circumstances are. WE DO NOT COVER YOUR EXPENSES!
~~We are not obligated to replace a puppy whose problem is a result of its new environment; including but not limited to, change of diet, lack of vaccinations, deworming, grooming, neglect, general health care, ect.
~~If the buyer chooses not to have this puppy checked by their veterinarian within 7 days from the date of purchase, and if puppy is not kept current on all vaccination and worming, then this puppy will be sold in “AS-IS” condition with no health guarantee of any kind. If a problem occurs, and health guarantee has been kept valid, buyer agrees to return pet for evaluation and/or replacement, or they may take pet to their vet and pay all medical costs.
~~We do NOT cover ANY infectious diseases including but not limited to, Parvovirus, Coronavirus, Distemper, Kennel Cough, and any dog flu’s virus, ect, because these can be contracted immediately after leaving our home!!!
~~We do NOT cover ANY parasites. All of our puppies have been dewormed. Coccidia parasites are always present in the puppy’s intestines, and stress, (such as changing homes), can cause the coccidian to overgrow to large numbers causing diarrhea, and Giardia can be picked up immediately upon leaving breeders home. In any case, it is the buyers’ responsibility to obtain treatment from their veterinarian, for any parasites that may exist.
~~We do NOT cover Hypoglycemia, low blood sugar, because this can be triggered from the stress of a new environment. Small breed puppies can be easily susceptible to this. Puppies that fly by air to their new homes may experience this and we are NOT responsible for this as Buyers are aware of the stress flying can cause to such small puppies. Buyer is advised to use Nutri-Cal or Karo syrup to prevent this.
~~This guarantee does NOT cover any problems associated with Luxating Patellas (sliding kneecaps), undescended testicles in males, under/over bite of the teeth, hernias, open fontanels, cherry eyes, dry eyes, aseptic necrosis, or any other condition that is NOT a life threatening congenital birth defect. You will be informed at the time of sale if we are aware or any of these conditions.

~~ The buyer has been provided with a complete medical history, if any, pertaining to this puppy, including vaccinations & worming given up to the date of sale.
~~If this puppy is to be returned for one of the medical reasons covered in the guarantee, we must be notified within 24 hours after the examination. If anything does occur, you are required to inform us so we can evaluate the parents and the other puppies from that litter in an attempt to determine the cause of the ailment and to eliminate the issue from our breeding program. We will then offer the buyer an exchange if one is available. If an exchange is not available, then the buyer will be given pick of a puppy of equal value from an upcoming litter. NO refunds will be given.
~~An exchange will only be given if the puppy is still covered by the 1 (one) year health guarantee and only AFTER we have received all medical records, test results, & veterinarian statements with a confirmed diagnosis. The statement must also state that diagnosis is, without doubt, a genetic problem, and that it is serious enough that it would require a non-elective surgery or euthanasia; or if applicable, a notice of death from the buyers’ veterinarian. All papers must be provided to transfer ownership of the puppy back to us.
~~It is the buyers’ responsibility to transport the puppy back to us. Transportation costs are the responsibility of the buyer, such as gas, airfare, etc.
~~In the case of untimely death of this puppy, an autopsy MUST be performed by a licensed veterinarian to find the cause of death. If a confirmed diagnosis of the puppies’ birth defect was made while the puppy was still alive, then an autopsy is not necessary. It is the buyers’ responsibility to arrange and pay for the autopsy. The buyer will NOT be reimbursed.
~~If this puppy was purchased for another person, & is given immediately (within 2 days) to that person, then this contract/health guarantee will be in effect for the new owner. Breeder must be made aware of this at time of purchase. The date of birth will still be used for the purpose of the health guarantee, not the date of ownership of the puppy was transferred to the new owner. If this puppy is resold/given to another party then this contract / health guarantee is void.
~~Any legal actions pertaining to said dog will take place in Sacramento California
